These Terms of Use and Advocacy Services (“Terms”) constitute an agreement governing access to and use of the website, programs, advocacy services, forms, scheduling systems, educational materials, communications, events, and other resources provided by Survivors Outreach Ministries, Inc. (“Survivors Outreach Ministries,” “SOM,” “the Organization,” “we,” “us,” or “our”).
By accessing this website, submitting an inquiry or intake form, scheduling or purchasing a service, providing documents or information, participating in an SOM program or event, or otherwise requesting or receiving services from the Organization, you acknowledge that you have read and understand these Terms and agree to be bound by them to the extent applicable to your use of the website or receipt of services.
Survivors Outreach Ministries, Inc. is a nonprofit organization operating for charitable and educational purposes, including victims’ rights advocacy, survivor support, public education, systems navigation, institutional accountability, public-integrity advocacy, community education, and related activities consistent with the Organization’s mission.
SOM provides non-crisis advocacy and educational services to individuals affected by domestic violence, post-separation abuse, coercive control, stalking, sexual violence, human trafficking, institutional failures, court-related challenges, abuse of authority, victim-rights concerns, and other forms of victimization.
The Organization may also engage in public education, systems-accountability initiatives, public-record research, policy advocacy, legislative education, institutional-reform advocacy, and review of information concerning alleged misconduct or failures affecting victims and communities.
Services offered by SOM may include victims’ rights advocacy, court and systems navigation, documentation support, organizational assistance, non-emergency safety planning, resource navigation, referrals, hearing and appointment preparation, court accompaniment when available, public education, community outreach, systems-accountability advocacy, research, public-record review, investigative advocacy, public-integrity advocacy, and other mission-related services.
Services are provided according to organizational capacity, program eligibility, geographic limitations, safety considerations, availability of personnel, the nature of the matter presented, applicable law, and SOM policies.
Acceptance of an intake form, telephone call, email, consultation request, payment, or document submission does not obligate SOM to accept a matter or provide continuing services.
SOM reserves the right to decline, limit, refer, suspend, or discontinue services when the Organization determines that a matter falls outside its scope, presents a conflict of interest, exceeds organizational capacity, creates safety or ethical concerns, involves conduct inconsistent with SOM policies, or cannot appropriately be handled by the Organization.
Survivors Outreach Ministries is a non-crisis advocacy organization.
SOM is not an emergency shelter, emergency housing provider, law-enforcement agency, government investigative agency, emergency response service, 24-hour crisis hotline, medical provider, or licensed mental-health treatment provider.
SOM does not maintain personnel or resources for continuous emergency response and should not be relied upon for immediate intervention in circumstances involving imminent danger.
Any person experiencing an immediate threat to life or safety should contact 911 or the appropriate emergency or crisis-response authority in that person’s jurisdiction.
Survivors Outreach Ministries is not a law firm.
Unless a person is expressly identified as a licensed attorney acting in that professional capacity pursuant to a separate written agreement, SOM staff members, advocates, officers, directors, volunteers, contractors, and representatives do not act as attorneys for persons receiving services.
Use of the website, submission of information, completion of an intake form, participation in advocacy services, receipt of documentation assistance, or communication with an SOM representative does not create an attorney-client relationship.
Nothing communicated by SOM through its website, advocacy programs, educational materials, telephone communications, email communications, social-media platforms, forms, or other services should be construed as legal representation.
SOM may provide general information concerning courts, agencies, administrative procedures, publicly available forms, victims’ rights, filing processes, documentation practices, procedural resources, and other legal-system information.
Such information is provided for educational, informational, administrative, and advocacy purposes and is not individualized legal advice.
When SOM assists an individual with locating, organizing, typing, formatting, or preparing information for a pro se form or filing, the individual remains responsible for determining the legal sufficiency and accuracy of the filing, reviewing the completed document, signing the document where required, and submitting it to the appropriate court or agency.
SOM does not determine legal strategy, advise a person regarding which legal claim should be pursued, guarantee that a filing is sufficient under applicable law, or substitute for advice from a licensed attorney.
Individuals requiring legal advice, legal interpretation, or representation should consult an attorney licensed in the appropriate jurisdiction.
SOM does not guarantee any particular legal, administrative, investigative, governmental, financial, housing, advocacy, or personal outcome.
The Organization has no authority to direct the decisions of judges, prosecutors, law-enforcement agencies, governmental agencies, regulatory bodies, housing providers, attorneys, benefit programs, service providers, elected officials, or other independent entities.
Payment for a service, submission of evidence or information, advocacy by SOM, referral of a matter, completion of documentation, or participation in an SOM program does not guarantee that a protective order will be issued, a case will be filed, criminal charges will be initiated, an investigation will occur, a complaint will be sustained, governmental action will be taken, benefits will be approved, housing will be obtained, counsel will accept representation, legislation will be adopted, or any other requested result will occur.
As a nonprofit organization, SOM may provide certain charitable, educational, referral, or advocacy services without charge while assessing reasonable program or service fees for other services.
Fee-based services may include, where permitted, administrative assistance, documentation support, court accompaniment, extended advocacy time, research, public-record review, specialized systems-navigation assistance, travel-related services, technology costs, preparation of organizational materials, and other services requiring substantial staff or organizational resources.
Any applicable fee will be communicated before the service is performed when reasonably practicable.
Amounts paid to SOM compensate the Organization for legitimate programmatic and operational expenses, which may include advocate time, administrative work, research, technology, transportation, documentation support, program administration, and related costs.
Payment to SOM does not purchase legal representation, governmental services, preferential treatment, access to public officials, influence over judicial or administrative decision-makers, law-enforcement action, prosecution, investigation, or any guaranteed outcome.
Revenue received through fee-based services is used in furtherance of the Organization’s nonprofit mission and operations.
Any payment, cancellation, rescheduling, or refund terms provided at the time a particular service is booked or purchased shall apply to that service and are incorporated into these Terms by reference.
Unless otherwise stated in writing, fees attributable to services already substantially performed are generally non-refundable.
Costs incurred on behalf of a client or participant, including filing expenses, travel expenses, processing fees, technology expenses, third-party charges, or other nonrecoverable expenditures, may also be non-refundable.
SOM may, in its discretion and consistent with applicable law, issue a refund, partial refund, credit, or rescheduled appointment when circumstances justify doing so.
Nothing contained in these Terms is intended to waive or restrict any non-waivable consumer right provided by applicable law.
As part of its victims’ rights mission, SOM may receive and review information concerning alleged institutional misconduct, victim-rights violations, abuse of authority, neglect of duty, misuse of public resources, retaliation, conflicts of interest, public-safety failures, financial misconduct, fraud, corruption, ethical violations, or other conduct affecting victims or communities.
SOM may conduct advocacy-centered research, review publicly available records, review materials voluntarily provided to the Organization, prepare factual timelines, organize documentation, identify issues requiring further review, educate the public, communicate concerns to appropriate institutions, and refer matters to governmental, regulatory, administrative, professional, ethics, legal, or law-enforcement authorities.
SOM is not a governmental investigative body and has no authority to adjudicate guilt, impose sanctions, compel testimony, issue subpoenas, prosecute offenses, or make binding legal findings.
The receipt or review of an allegation by SOM does not establish that misconduct occurred.
The Organization seeks to distinguish allegations, public records, verified facts, official findings, advocacy analysis, and opinion when publishing or communicating about public-interest matters.
Individuals may voluntarily provide SOM with records, photographs, screenshots, correspondence, court documents, public records, recordings lawfully possessed by the submitting person, timelines, witness information, reports, or other material relevant to an advocacy request.
By submitting information or materials to SOM, the submitting person represents that the person has a lawful basis to possess and provide the material and that the person will not knowingly submit fabricated, falsified, unlawfully obtained, or materially altered information for the purpose of misleading SOM or another party.
Submission of documents or information does not obligate SOM to accept a matter, conduct an investigation, authenticate evidence, publish information, communicate with another person or agency, make a referral, or undertake advocacy action.
SOM retains discretion regarding whether and how submitted information will be reviewed or used, subject to applicable law, organizational policy, consent requirements, and the purpose for which the information was provided.
SOM may accept information from individuals who request that their identities not be publicly disclosed.
A request for anonymity does not create an absolute guarantee that a person’s identity or submitted information can never be disclosed.
SOM cannot guarantee confidentiality where disclosure is required by applicable law, valid legal process, court order, subpoena, mandatory-reporting obligation, legitimate safety concern, or another lawful requirement.
Anonymous submissions may limit SOM’s ability to authenticate information, request clarification, determine credibility, provide follow-up assistance, or refer a matter to another authority.
Submission of information to SOM does not, by itself, create attorney-client privilege, journalist-source privilege, law-enforcement privilege, psychotherapist-patient privilege, or any other legally recognized evidentiary privilege.
SOM seeks to handle personal, survivor-related, advocacy-related, and organizational information responsibly.
Nevertheless, no method of electronic transmission, digital storage, email communication, text messaging, online form submission, cloud storage, or internet communication can be guaranteed to be completely secure.
By communicating electronically with SOM, the user acknowledges the inherent security limitations associated with electronic communications.
SOM’s collection, use, retention, and disclosure of personal information are further governed by the Organization’s Privacy Policy, which is incorporated into these Terms by reference.
SOM may provide contact information, resource information, or referrals involving attorneys, nonprofit organizations, governmental agencies, shelters, medical providers, counselors, transportation resources, housing resources, community organizations, victim-service agencies, or other third parties.
Unless expressly stated otherwise in writing, the provision of a referral does not create a partnership, joint venture, agency relationship, endorsement, employment relationship, or guarantee concerning the referred provider.
SOM does not control and cannot guarantee the availability, eligibility requirements, competence, fees, professional judgment, conduct, privacy practices, security practices, or outcomes associated with an independent third party.
Individuals are responsible for independently evaluating any third-party provider or service.
The SOM website and organizational communications may contain links to websites, databases, publications, agencies, organizations, forms, or resources maintained by third parties.
Such links are provided for informational convenience.
Unless expressly stated otherwise, the presence of a link does not constitute SOM’s endorsement of or affiliation with the third party.
SOM is not responsible for the availability, accuracy, security, policies, practices, representations, or content of independent third-party websites or resources.
SOM may rely upon publicly available court records, governmental records, official reports, meeting records, news reporting, corporate records, campaign records, public statements, organizational records, social-media content, and other lawful sources in conducting research and advocacy.
The existence of a person’s or organization’s name in a public record, report, complaint, court filing, or SOM research material does not, standing alone, establish unlawful conduct.
SOM may correct or update published material when credible information demonstrates that a material statement is inaccurate or incomplete.
Except where otherwise indicated, original content created by SOM, including written materials, advocacy publications, training materials, graphics, branding, logos, photographs owned by SOM, program materials, educational content, videos, presentations, forms, and organizational publications, is owned by or licensed to Survivors Outreach Ministries and may be protected by federal and state intellectual-property law.
No person may reproduce, modify, republish, distribute, sell, license, falsely attribute, or commercially exploit SOM intellectual property without authorization except to the extent permitted by law.
Nothing in these Terms restricts lawful quotation, commentary, criticism, news reporting, educational use, or other activity protected by applicable law.
When a person voluntarily submits material to SOM for advocacy, review, documentation, referral, educational, or public-interest purposes, the person grants SOM a limited authorization to review, store, organize, reproduce internally, and use the material as reasonably necessary for the purpose for which it was provided.
Submission of material does not automatically authorize SOM to publicly disclose confidential identifying information concerning a survivor or confidential source.
Any public disclosure of identifying information remains subject to applicable law, consent requirements where applicable, organizational policy, and SOM’s Privacy Policy.
The SOM website, forms, services, programs, communications, and personnel may not be used to facilitate unlawful activity; knowingly submit false or fabricated evidence; impersonate another person; unlawfully obtain confidential information; harass, stalk, threaten, intimidate, retaliate against, or defame another person; interfere with the operation or security of the website; introduce malicious software; falsely represent affiliation with SOM; conduct unauthorized fundraising in SOM’s name; infringe SOM intellectual property; manipulate the Organization into knowingly publishing false information; or otherwise misuse SOM programs or services.
SOM may restrict access to its website, communications, programs, personnel, or services when there is a reasonable basis to believe that such resources are being misused.
Persons receiving services are expected to maintain appropriate and respectful communications with SOM directors, officers, employees, advocates, volunteers, contractors, and program participants.
Threatening, abusive, harassing, discriminatory, sexually inappropriate, retaliatory, fraudulent, or materially disruptive conduct may result in limitation, suspension, or termination of services.
Participation in SOM advocacy does not create a fiduciary, therapeutic, employment, attorney-client, law-enforcement, or personal relationship between an advocate and the person receiving services.
Any separate written client-service agreement, advocacy agreement, consent form, code of conduct, or program policy provided to a participant remains enforceable according to its terms to the extent permitted by law.
SOM makes reasonable efforts to provide accurate and useful information; however, laws, administrative procedures, agency policies, court requirements, forms, programs, contact information, eligibility criteria, and third-party resources may change without notice.
Information appearing on the website should not be relied upon as a substitute for current information obtained directly from the responsible court, governmental agency, licensed professional, service provider, or other authoritative source.
SOM may revise, correct, remove, or update website content at any time.
To the fullest extent permitted by applicable law, the website, general educational content, and publicly available online resources are provided on an “as is” and “as available” basis.
SOM does not warrant that the website will operate without interruption, that all content will remain continuously available, that every third-party link will remain active, or that every publicly available resource will remain current.
Nothing in this provision limits any warranty or consumer protection that applicable law does not permit the Organization to disclaim.
To the fullest extent permitted by applicable law, Survivors Outreach Ministries and its directors, officers, employees, volunteers, contractors, representatives, and agents shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of the website, reliance upon general educational information, a third-party referral, or circumstances outside the Organization’s reasonable control.
SOM does not assume responsibility for independent decisions made by courts, governmental agencies, attorneys, law-enforcement agencies, prosecutors, medical providers, mental-health professionals, housing providers, employers, service providers, or other third parties.
Nothing in these Terms is intended to exclude, restrict, or waive liability where such exclusion, restriction, or waiver is prohibited by applicable law.
To the extent permitted by applicable law, a person who knowingly and unlawfully misuses SOM’s website, intellectual property, services, name, submitted-information process, or organizational resources may be responsible for claims, losses, liabilities, damages, or reasonable expenses resulting from that person’s unlawful conduct.
This provision shall not be interpreted to penalize or discourage any person from making a good-faith request for victim advocacy, submitting a good-faith complaint, reporting suspected misconduct, exercising a lawful right, or participating in a legally protected activity.
SOM may decline, suspend, restrict, or discontinue services when reasonably necessary because of safety concerns, threats, harassment, fraud, material misrepresentation, conflicts of interest, repeated boundary violations, attempted unlawful use of services, circumstances outside the Organization’s scope, lack of organizational capacity, or other circumstances that make continued services inappropriate.
Termination of advocacy services does not obligate SOM to locate a replacement provider.
When reasonably practical and appropriate, SOM may provide information concerning alternative resources.
General educational information made available by SOM may be viewed by members of the public, including minors.
A minor generally may not independently enter into a fee-based service agreement with SOM unless permitted by applicable law and accepted by the Organization.
When consent from a parent, guardian, custodian, or other legally authorized person is required by law, SOM may require appropriate authorization before accepting or continuing services.
Nothing in this section is intended to interfere with any legal right a minor may independently exercise under applicable state or federal law.
By voluntarily providing an email address, telephone number, or other electronic contact information to SOM, an individual authorizes SOM to use that method of communication for matters reasonably related to the individual’s inquiry, appointment, advocacy services, program participation, or other communication with the Organization.
Individuals are responsible for informing SOM if a communication method is unsafe or should not be used.
SOM does not guarantee that an email, voicemail, text message, or electronic submission will be reviewed immediately.
Except to the extent superseded by applicable federal law or mandatory law of another jurisdiction, these Terms shall be interpreted in accordance with the laws applicable to Survivors Outreach Ministries, Inc. as a North Carolina nonprofit corporation.
Services performed in another state, including Florida, remain subject to any mandatory laws and regulations applicable to the particular service or transaction in that jurisdiction.
The governing-law and venue provisions applicable to a separate written service agreement, if any, shall control with respect to that agreement.
If a court of competent jurisdiction determines that any provision of these Terms is invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed if necessary, and the remaining provisions shall continue in full force and effect.
Failure by SOM to enforce any provision of these Terms on one occasion shall not constitute a waiver of the Organization’s right to enforce the same or any other provision on a later occasion.
Any waiver by SOM must be expressly stated in writing by a person authorized to act on behalf of the Organization.
SOM reserves the right to amend these Terms to reflect changes in law, organizational structure, programs, services, technology, policies, or operational requirements.
The current version will be identified by the revision date appearing at the beginning of the document.
Changes become effective upon publication unless a different effective date is expressly stated.
These Terms, together with SOM’s Privacy Policy and any applicable written intake agreement, advocacy-service agreement, payment policy, program policy, consent, release, or service-specific terms, constitute the agreement governing the applicable website use or service relationship.
Where a specific written service agreement contains terms that differ from these general Terms, the specific written agreement shall control as to the service governed by that agreement.
